President Trump’s December 11, 2025 Executive Order aims to protect American AI innovation from what it characterizes as overly burdensome state AI laws by creating a Department of Justice AI Litigation Task Force to identify and challenge problematic state regulations, conditioning federal Broadband Equity, Access, and Deployment (BEAD) Program funding on state AI policy alignment, directing the Federal Communications Commission (FCC) to consider preemptive federal AI reporting standards, and instructing the Federal Trade Commission (FTC) to clarify how Section 5 of the FTC Act applies to AI in ways that could preempt conflicting state laws. The Executive Order stops short of imposing the broad 10-year moratorium on state AI laws that was previously proposed in legislation, instead taking a more targeted approach that carves out state authority over child safety, AI infrastructure, and government AI procurement. The Executive Order also calls on Congress to enact a uniform federal AI framework.
